What is Civil Litigation?

Civil litigation cases involve all types of disputes where either an individual or group takes action against another individual or group to right a wrong that has been committed. This body of law does not include criminal law in which federal, local or state governments prosecute an individual for a crime. When you hear someone refer to a “lawsuit”, civil litigation is typically the area of law they are describing.  In many cases, civil law suits are settled prior to a formal court trial through arbitration or negotiated settlements in which both parties agree to a monetary settlement.

The process typically begins when an individual files a complaint in court. The party the complaint was filed against has the opportunity to answer the complaint. After the defendant has had the opportunity to answer the complaint, the matter then enters into the discovery phase. During discovery, both sides are presented with the evidence that will be presented at trial. Following discovery, a trial date is set. Most “lawsuits” end shortly after this stage because the parties settle the dispute prior to going to trial. If the settlement cannot be reached prior to the trial, the trial begins and both parties present their evidence. The ending result is typically a monetary judgement decided by either a judge or jury.
